In the case of a contract for the purchase of products and services concluded by a consumer Buyer, the latter shall have the right to withdraw from the same contract, pursuant to and for the purposes of Article 52 et seq. of the Consumer Code (d. lgs. 206/2005), without penalty and without specifying the reason.

The decision to exercise the right of withdrawal must be communicated by the Consumer Buyer within 14 (fourteen) days of receipt of the product; in the case of separate delivery of several goods, ordered by the Consumer Buyer in a single order, the period of 14 (fourteen) days for the exercise of the right of withdrawal starts from the day on which the last good is delivered.

The right of withdrawal is exercised by sending, by the Consumer Customer, within the above-mentioned 14 (fourteen) days:

1. Of the standard form available at this link in a PDF version, to be placed filled out in its entirety in the return package and sent by e-mail to info@www.simonetessadori.com

2. Of any other explicit statement of the decision to want to withdraw from the contract to be sent by e-mail to e-mailinfo@www.simonetessadori.com

The notice of withdrawal must specify the desire to withdraw from the purchase and the product or products for which the right of withdrawal is to be exercised, attaching a copy of the documentation evidencing the purchase.

Simone Tessadori & C. Srl shall notify the consumer Buyer without delay an acknowledgement of receipt, by e-mail to the e-mail address provided during the purchase procedure on the Site, of the withdrawal exercised.

In accordance with the provisions of Article 59(c) and (d) of the Consumer Code, the Consumer Buyer may not exercise the right of withdrawal for products that are custom-made or clearly personalized or are likely to deteriorate or alter rapidly. In addition, he or she may not exercise the right of withdrawal in relation to sealed products that are not suitable for return for hygienic or health protection reasons and have been opened after delivery (Art. 59(i) of the Consumer Code).

The products for which the right of withdrawal is exercised must be returned within 14 (fourteen) days from the day on which the Consumer Buyer has communicated the exercise of the right of withdrawal, substantially intact, in their original packaging, complete with accessories and any manuals, without any lack. The only expenses payable by the Consumer Buyer for the exercise of the right of withdrawal are the direct costs of returning the goods (shipping costs), as provided for in Article 57(1) of the Consumer Code.

Once the request for withdrawal has been received, Simone Tessadori & C. Srl, after the appropriate checks i.e. that the material returned is as good as new and / or unused, will refund the full amount paid by the Consumer Buyer within the period of 14 (fourteen) days from the date on which the Consumer Buyer has exercised the right of withdrawal, by re-crediting the bank account used at the time of purchase, or using the bank details provided by the Consumer Buyer with the notice of withdrawal and in any case using the same method of payment used by the Consumer Buyer at the time of purchase. Simone Tessadori & C. Srl reserves the right to withhold the refund until it has received the products subject to the right of withdrawal.

If, on the other hand, the procedures, conditions and terms for the exercise of the right of withdrawal, as specified in this article, are not respected, the Consumer Buyer will not be entitled to a refund of the sums already paid. In this case, the Consumer Buyer may re-obtain, at its own expense, the product in the state in which it was returned toSimoneTessadori & C. Srl. Otherwise,Simone Tessadori & C. Srl may retain the returned products, in addition to all sums already paid by the Consumer Buyer for the relevant purchase. Shipping and transportation costs are placed at the expense of the Buyer.
